General Terms and Conditions for Official Supporters Club Events
1. GENERAL
1.1 Manchester City Football Club (the “Club”) may host, provide, or make available, events for the Club’s Official Supporters Club (“OSC”). These events may be:
1.1.1 Events which are ran by the Club for the OSC at the Club’s premises (including, for example, at the Etihad Stadium, or the Academy Stadium);
1.1.2 Events which are ran by the Club (or on the Club’s behalf) for the OSC at a third-party location,
each a “Club Event”;

1.1.3 Third party events, at third party locations, which the Club are giving OSC members access to, but over which the Club has no involvement or control (a “Third-Party Event”),
each, and together, an “Event” or “Events”.


1.2 By attending/booking an Event you fully agree to these Event Terms and Conditions (“Event T&Cs”). In addition to these Event T&Cs, each Event will also have its own specific terms. Any specific terms relating to Club Events will be made available as part of the promotion of such Club Event on the relevant section of www.mancity.com (the “Website”). Please also be aware that where Club Events are held at third-party locations, additional venue terms and conditions may apply (“Venue Terms”). The Club accepts no responsibility or liability in respect of Venue Terms.


1.3 Third-Party Events: In respect of Third-Party Events, the Club is acting as a mere conduit in passing information relating to the Third-Party Event to you, and where you agree, sharing booking information back with the relevant third party. Third-Party Events will have their own applicable terms and conditions. You are responsible for familiarising yourself with such terms, and the Club accepts no responsibility or liability (to the fullest extent permitted by applicable law) in respect of Third-Party Events, as they are Events over which the Club has no control.


1.4 These terms, along with the Club’s privacy policy, cookie policy and any other terms on the Website apply to all Events you book or attend. Please read these terms carefully before you sign up for or book, an Event, as they set out important information about your and the Club’s rights and obligations. By continuing to book, or sign-up to an Event, ran by us (or in the case of Third-Party Events, provide you information or complete a booking form), you confirm you agree with these Event T&Cs. The privacy and cookies policies of third parties may also apply and it is your responsibility to familiarise yourself with such policies.


1.5 The Club often take photographs at Events for marketing purposes – you can see some previous photographs on the Website, press releases, social media, and advertising materials. By attending an Event, you consent to us using any images in which you may be present, for the Club (or its affiliates) business purposes (including without limitation promotional and advertising purposes). Should you not wish to appear in any images, please notify the photographer at the Event or let the Club know in advance of the Event and it will notify the photographer and use its best efforts to ensure you are not included in any photographs.


1.6 Please note that:
1.6.1 For the purposes of these terms, all Events are considered “services” and not “goods”;


1.6.2 Depending on the nature and venue of the event, age restrictions may apply. The registration form and the applicable Event terms and conditions will outline any restrictions and where relevant, any requirements for accompanying adults.


1.6.3 The Club may make changes to these terms at any time and will produce an updated copy on its Website. In the event of any material changes, these will be notified to you by email;


1.6.4 The nature and availability of the Event will determine if you can sign up on behalf of other supporters (“Other Attendee(s)”). This will be made clear in the registration form. The Club will not be liable if you bring Other Attendees to Events who have not registered and had confirmation of their registration and such Other Attendees will be refused entry and/or asked to leave; and


1.6.5 Unless otherwise specified in the specific Event terms, or on the registration/ booking form, anyone booking, registering for, or attending an Event, must be a member of the OSC.


2. EVENTS
2.1 To provide Club Events, the Club will sometimes rely on third party service providers, such as caterers, venues, and entertainment providers. For this reason, the Club does not guarantee that the Club Event or any associated goods and/or services will be provided as described or as advertised. Advertising materials are for advertising purposes only and should not be relied upon as any representation of the Club Event.


2.2 If necessary, the Club may impose additional requirements, before you attend a Club Event (such as measures related to any ongoing epidemic or pandemic). These requirements, alongside any government or regulatory advice and guidelines, are imposed in the interest of your safety, the safety of other attendees and the safety of the Club’s suppliers. You must respect and abide by these requirements at all times.


2.3 The Club is only responsible for Club Events. Where events are: (a) organised by members of the OSC and not by the Club; and/or (b) Third-Party Events, the Club excludes all liability (to the fullest extent permitted by applicable law), in respect of those events/ Third-Party Events.


3. TICKETS
3.1 By registering to attend an Event, you are making an offer to the Club. Mere registration or sign-up does not guarantee your place at an Event. You will only be deemed to have a place on the Event, once you have received an email confirmation from the Club notifying you of that fact.


3.2 Where applicable, if you have registered on behalf of Other Attendees (in accordance with section 1.6.4 of these Event T&Cs) you shall be deemed to be acting with the authority of each such Other Attendee, including the authority to agree to these Event T&Cs on any Other Attendee’s behalf. Such application on behalf of Other Attendees must be for his/her/their personal use only and is CONTINGENT ON:
a. Such registration taking place in consideration of no payment or benefit, in the course of any business or for the purpose of facilitating any third party’s business; and
b. The Other Attendee being a member of the OSC.


3.3 The Club always tries to ensure that Event, registration and booking information provided by the Club is correct, but errors may occur. Upon the Club becoming aware of any Event, registration and/or booking description error in relation to an Event, the Club will endeavour to inform you as soon as reasonably practical able using the contact details provided by you to the Club. You will have the option of reconfirming or cancelling your registration. If the Club is unable to contact you having made reasonable attempts to do so, the Club will assume you would still like to attend the Event and process your registration as usual.


3.4 Once your registration has been confirmed, the Club may contact you to request further details, such as any dietary requirements or other requirements relevant to an Event. If the Club contact you, you must provide the Club with the details promptly, and in any event, no later than one week prior to the Event so that the Club can put in place measures to endeavour to meet any such reasonable requirements.


3.5 Depending on the nature of the Event, in order to participate in the Event fully and/or participate in certain activities or activations at the Event, you may be required to sign other terms and conditions and/or waivers. This will be brought to your attention at the Event itself, and while it is your choice as to whether to sign other terms and/or waivers, participation may be dependent on the same, and the Club will have no liability or responsibility if your refusal means you are unable to fully enjoy, experience or participate in the Event.


3.4 Where under 18’s are able to attend an Event, their accompanying adult, parent(s) and/ or legal guardian(s) shall, be responsible for the child’s actions, conduct and compliance with the Event T&Cs, and any other terms and conditions and/or waivers.

4. SPECIAL REQUESTS AND MAKING CHANGES
4.1 Any special requests must be advised to us at the time of booking. Whilst every effort will be made by the Club to try and arrange your reasonable special requests, the Club cannot guarantee that they will be fulfilled. The fact that a special request has been noted on any confirmation or any other documentation or that it has been passed on to a third-party is not confirmation that the request will be met. The Club excludes (to the fullest extent permitted by applicable law) any liability in respect of a failure to meet any special requests, and the Club do not accept bookings, orders, or purchases that are conditional upon any special request being met.


4.2 If you would like to make any changes or update your details, please contact the Club as soon as possible via [email protected]. The Club reserves the right to ask for further information, evidence or reject the request at its absolute discretion.


5. AVAILABILITY
All Events are subject to availability, and some Events may be ticketed, or guest listed. The Club makes no guarantees whatsoever in respect of availability. Where Events are ticketed, all tickets are non-transferable, non-exchangeable and have no cash value.


6. EVENTS CANCELLED, DELAYED, POSTPONED, RESCHEDULED OR MOVED BY THE CLUB
6.1 Occasionally, Club Events may be cancelled, delayed postponed, rescheduled to a different date or different time, or moved to a different venue.


6.2 Cancelled: If the Club Event is cancelled by the Club for reasons other than Circumstances Beyond the Club’s Control (see section 8) no action is required by you. The Club will contact you to update you on the status of the Club Event and inform you of any refund procedures and options available. The exact options will depend on the nature of the Club Event and the impact of the cancellation.


6.3 Delayed: The Club will do all that it reasonably can to provide the Club Event at the time(s) and date(s) specified. If there might be a delay before the Club can start or restart the Club Event for reasons other than Circumstances Beyond the Club’s Control (see section 8), the Club will contact you to let you know as soon as reasonably possible. If the services are delayed by more than 2 hours, the Club will contact you to update you on the status of the Club Event.


6.4 Postponed, rescheduled, or moved: If the Club Event is postponed, rescheduled, or moved by the Club for reasons other than Circumstances Beyond the Club’s Control (see section 8), your ticket(s) and/or booking will still be valid, and no further action is required by you.


The Club will not be liable for travel or any other expenses/losses that you or anyone else incurs in connection with any cancelled, delayed, postponed, rescheduled, or moved Club Event.


6.5 Where a Club Event is cancelled, delayed, postponed, rescheduled, or moved due to a Circumstance Beyond the Club’s Control, please see section 8.


7. CANCELLATION BY YOU
7.1 As a matter of courtesy, if you are no longer able to attend an Event please contact the Club via [email protected] as soon as you are able to. The Club would rather have a realistic view on Event numbers in order to help with management of the Event (e.g., safety, catering (if applicable)), and if the Event has limited places, might like to be able to re-offer the place to other members of the OSC.


8. CIRCUMSTANCES BEYOND THE CLUB’S CONTROL
8.1 The Club shall not have any liability for any failure or delay in performance of the Club’s obligations under these Event T&Cs to the extent the failure or delay results from or arises out of a Circumstance Beyond the Club’s Control, for as long as such event means that performance of the Club’s obligations under these Event T&Cs in full or in part, is delayed or is not possible.


8.2 For the purposes of these Event T&Cs, a “Circumstance Beyond the Club’s Control” shall mean any event or sequence of events beyond the Club’s control and which prevents it from, or delays it in, performing its obligations under the contract including, but not limited to: acts of God, fire, explosion; natural disaster; severe weather; acts or threats of, terrorism or war; embargo, blockade, imposition of sanctions or breaking off of diplomatic relations; an official period of mourning, law, order, rule, regulation or direction; epidemic or pandemic (including any current or ongoing effects of Covid-19 and any future strain of the coronavirus); lockdown or other government restrictions; labour dispute, strike, industrial action, lockout or boycott; interruption or failure of utility service, including electric power, network, systems and back-up systems, gas, water, internet or telephone service; collapse of buildings; failure of machinery, computers or vehicles; unpredictable traffic delays; accidents; non-performance by suppliers or sub-contractors; failure of third party services; internet failures; or, malicious or negligent damage.


9. YOUR BEHAVIOUR
9.1 All attendees at Club Events are expected to:9.1.1 conduct themselves in an orderly and acceptable manner, with respect for the venue, its staff, and suppliers and any other third parties;


9.1.2 avoid using offensive language or acting in any way which could damage the Club’s reputation or bring the Club into disrepute;


9.1.3 comply with any Covid-19 specific measures if applicable (including where applicable social distancing, sanitising, and wearing masks);


9.1.4 comply with any notified Club policies;


9.1.5 not disrupt the enjoyment of others;


9.1.6 at all times behave in a safe, responsible, and courteous manner;


9.1.7 comply with all instructions issued lawfully by any Club, venue, or supplier representative (or if relevant, stewarding staff, the Police or any other lawful body);


9.1.8 comply with all age restrictions;


9.1.9 ensure prompt arrival (if arrival timing is applicable); and


9.1.10 dress appropriately for the Club Event and comply with any notified dress code.


9.2 If in the Club’s opinion or the opinion of the Club, the Club’s, venue or supplier representative(s), your behaviour is contrary to the conditions set out above, or is otherwise causing or is likely to cause distress, danger or annoyance to any other attendees or third party, damage to property, or cause a delay to the Club Event, the Club reserves the right to either refuse entry to the Club Event, or instruct you to leave the Club Event.


9.3 In the circumstances set out in section 9.2, the Club will have no further obligation or liability to you. No reimbursement for expenses, costs, or losses will be payable.


9.4 Whether or not you are refused entry to the Event or instructed to leave the Event, you may also be required to pay for loss and/or damage caused by your actions. Full payment for any such damage or losses must be paid directly to the Club or the third-party supplier either: (a) where the damage/loss is immediately quantifiable, prior to departure from the Club Event; or (b) where the extent of the damage/loss is unknown, on written notice to you by the Club detailing the particulars and amount due. If you fail to make payment, you will indemnify the Club against all claims (including legal costs and expenses) subsequently brought against the Club as a direct or indirect result of your actions, together with all costs and expenses incurred by the Club in pursuing any legal claim or debt against you.


9.5 The Club is not responsible nor liable for the actions, omissions or behaviour of individuals, bystanders, suppliers or third parties who are not directly employed or engaged by the Club.


10. DATA PROTECTION
You acknowledge and agree that the Club will hold and process data relating to you, which may include personal data, for administrative, security and legal purposes. The personal data that you provide to the Club shall be collected, processed, stored and transferred in accordance with the Data Protection Act 2018, the Privacy and Electronic Communications Regulations 2003, the General Data Protection Regulation ((EU) 2016/679) as it forms part of domestic UK law, and the Club’s Privacy Policy (available on the Website at www.mancity.com/Common/Privacy). In particular, with your consent (which you provided when you registered as a Cityzens Member) we will send you marketing materials about Events which may be of interest to you. We may also share your data with our affiliates, third party venues, suppliers and other parties who reasonably need to access your personal data to facilitate the relevant Event (whether this is in or outside your country of origin).


11. THIRD PARTY EVENTS
11.1 To register for a Third-Party Event, you will be required to provide your details on the Cityzens Platform. By providing the booking/ registration information on the Cityzens Platform you agree for such data to be shared with the relevant third party.


11.2 By registering to attend a Third-Party Event, you are confirming acceptance of the Third-Party’s terms and conditions, in respect of such Event.


11.3 The Club accepts no liability in relation to any Third-Party Event, and any concerns or queries you have must be directed to the third party running the Event.


12. CLUB LIABILITY
12.1 If the Club breach these terms or are negligent, the Club are liable to you for foreseeable loss or damage that you suffer as a result. ‘Foreseeable’ means, it was either clear that such loss or damage would occur, or you and the Club both knew that it might reasonably occur, as a result of something the Club did (or failed to do).


12.2 The Club are not liable for any loss or damage that was not foreseeable, any loss or damage not caused by the Club’s breach or negligence, or any business loss or damage.


12.3 Nothing in these terms excludes or limits the Club’s liability for any death or personal injury caused by its negligence, liability for fraud or fraudulent misrepresentation, or any other liability that the law does not allow the Club to exclude or limit.


13. MISCELLANEOUS
13.1 If you are unhappy with the Club or a Club Event, please contact the Club as soon as possible at [email protected].


13.2 These Event T&Cs and any dispute or claim arising out of, or in connection with, these Event T&Cs, their subject matter or formation (including non-contractual disputes or claims) will be governed by, and construed in accordance with, the laws of England. You and the Club both irrevocably agree that the courts of England will have exclusive jurisdiction to settle any dispute or claim arising out of, or in connection with, these Event T&Cs, their subject matter or formation (including non-contractual disputes or claims).


13.3 These Event T&Cs are personal to you, and nobody else will have any right to enforce them.


13.4 The Club may transfer its rights under these Event T&Cs to another business without your consent but will notify you if this happens (unless it is to another group company) and will ensure your rights are not adversely affected as a result.


13.5 If any provision of these Event T&Cs (or part of any provision) is or becomes illegal, invalid, or unenforceable, the legality, validity, and enforceability of any other provision of these Event T&Cs will not be affected.


13.6 If you breach these Event T&Cs and the Club, take no action, this does not mean the Club waives any of its rights under these Event T&Cs and the Club will still be entitled to enforce any of its rights and/or remedies in respect of the particular situation and any other situation where you are in breach of these Event T&Cs.


13.7 You and the Club agree that these Event T&Cs, together with any specific terms and conditions in respect of a particular Club Event constitute the entire agreement between you and the Club in respect of such Club Event.


13.8 You acknowledge that you have not entered into these terms in reliance on any representation or warranty that is not expressly set out in these Event T&Cs and that you have no claim for innocent or negligent misrepresentation on the basis of any statement in these Event T&Cs.


13.9 Any reference to “include”, “including” or similar within these Event T&Cs shall not be intended to be restrictive and any words following such phrase, shall be read by way of example.
